Retaliatory Actions Involving the FMLA and Other Employee Rights
The FMLA covers federal and private sector employers with 50 or more employees. To be eligible, an employee must have worked for at least 1,250 hours in the 12 months preceding the leave. The FMLA allows eligible employees to take up to 12 weeks of unpaid, job-protected leave in a 12-month period for family and medical reasons. Employees who return from FMLA leave must be given their original job or an equivalent job with equivalent pay, benefits and other terms and conditions.
Federal and state laws prohibit employer retaliation against government and private sector employees who take FMLA leave as well as employees who:
- Filed for workers’ compensation
- Complained about workplace discrimination or filed discrimination charges
- Participated in discrimination investigations or lawsuits
- Participated in the Whistleblower Protection Act
- Refused to participate in illegal activity
- Report safety violations
- Make complaints about unpaid compensation
